For the people who does not know what has happened - background info here

If this does not make you fired up, nothing will! Liverpool Council needs to be taught a lesson and they have just been given a blooded nose.

Congratulations to the people of Hoxton Park and especially Marella Harris and the team at Hoxton Park Residents Action Group Inc.

This should also serve as a warning to developers everywhere; DON'T MESS WITH THE LOCALS! YOU WILL LOSE. EVERY TIME.

Malek Fahd School Round 3

A big win in court on Friday 23/3/2012 - As decided by The Honourable Justice P.M. Biscoe:

1. DA-346/2009 (being for the school) is invalid.
2. The school are not to carry out any work on the site unless a further consent authorising work is granted.
3. The site is not to be used as a school unless a further consent authorising such is granted.
4. Order 3 above is suspended until 31 March 2013 (i.e. the school can operate for a further 12 months during which time a new DA could be considered).
5. The respondents are to pay the applicant's costs (costs are to be shared between Liverpool City Council, Australian Federation of Islamic Councils
Inc and Malek Fahd Islamic School Limited).
6. The Australian Federation of Islamic Councils Inc and Malek Fahd Islamic School Limited are to indemnify LCC in respect to applicant's costs caused
by their unsuccessful defence of the case (the additional HPRAG costs created by the school's defence of the matter are to be paid by the school
not LCC).

What this means:

The Development Application as approved by Liverpool Council is obviously INVALID. In other words, Liverpool Council did a shonky job when they approved the application.

No more construction is allowed on the site. The school has been allowed some time to make the structure water tight. The general manager of Liverpool Council is strangely saying that construction is allowed to continue until Wednesday 28/3/2012 and may be extended. That is INCORRECT and in direct violation of the court order.

The school can continue to operate in its current form and size until 31 March 2013.
Then the school has to shut its doors and hopefully the demolition bulldozers will move in or reapply for another DA. But one would think that Liverpool Council would think very very carefully before approving this again. And there is an election this year and just to remind you all who the councillors were who voted to approve this shonky development:

Traffic

The traffic in the area is very congested as it is now, even without another school. Anyone who travels in or out of the Hoxton Park estate during peak hours or even along Hoxton Park Rd will know how bad the traffic is. Adding another school with eight hundred (800) students is simply not feasible. Secondly, the area does not need another school. What is needed is better and wider roads to cope with the traffic that exists already. If this development is allowed to proceed, the traffic will simply become unbearable and Hoxton Park will cease to function. The widening of Hoxton Park will not adequately cater for future traffic volumes.

Additionally, there is already more residential developments going on in the area and these will also add to the congestion.

Property Values

These are very much influenced by the traffic conditions in and around the estate.
One objection against another development raised was:
“Concern was raised that the proposal will devalue properties.”
COUNCILS COMMENT WAS: “Property values are not a relevant planning matter for consideration and no evidence exists to suggest that this may occur.”
If the impacts on property values are not considered during planning, when ARE they considered?
And if they are NOT, why not?
It should be considered at some point.
If protecting the property values for the local residents is not looking after the local community, I do not know what is. This IS the job of council – to work in the interest of the local community – which should come first – every time!

Safety

Many residents of Hoxton Park have been concerned about the safety of their families due to the continual gridlock in the area and have vowed that the safety issue cannot be solved by any traffic measures as the area is hemmed in by a number of congested arteries and the proposed developments are only going to worsen the situation.
